Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MyLevelBid platform, website, and related services (the “Service”). By creating an account, accessing the platform, or using any MyLevelBid service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not access or use the Service. We may update these Terms from time to time; continued use after changes take effect constitutes acceptance.
1. Acceptance of terms
By registering, accessing the platform, requesting a demonstration, or using any part of the Service, you acknowledge that you have read and agree to these Terms, that you will use the Service in accordance with applicable laws, and that you have authority to enter into this agreement. If you are using MyLevelBid on behalf of a company or organization, you represent that you have authority to bind that organization, and “you” means the organization.
2. Use of the service
MyLevelBid provides a cloud-based construction bid intelligence platform that helps construction professionals organize, analyze, and compare subcontractor proposals. You agree to use the Service only for lawful business purposes. You are responsible for:
- Maintaining accurate account information
- Keeping login credentials secure
- Restricting unauthorized access to your account
- Ensuring users within your organization comply with these Terms
- Maintaining appropriate backups of your own files and information
You are responsible for all activity conducted through your account, and should notify us promptly of any unauthorized use.
3. Your decisions are yours
The Service produces automated analysis of the documents you provide. That analysis is decision support — it is provided for informational purposes, may contain errors or omissions, and depends on the quality and completeness of the documents you upload.
You are responsible for verifying all figures, scope interpretations, and comparisons against the source documents before relying on them, and for every bidding, award, negotiation, and contract decision you make. The Service does not replace professional construction, estimating, legal, financial, or project-management advice, and we are not a party to any contract between you and your subcontractors, suppliers, or clients.
4. Acceptable use
You agree not to:
- Use the platform for unlawful purposes
- Attempt to gain unauthorized access to the platform or systems
- Reverse engineer, copy, modify, or distribute the platform
- Interfere with platform security or performance
- Upload malicious files, viruses, or harmful code
- Use the Service to violate third-party rights
- Resell or white-label the Service without our written agreement
- Use the Service, or its outputs, to build a competing product
MyLevelBid reserves the right to restrict access where misuse, security risks, or violations of these Terms occur.
5. Customer data & bid information
You retain ownership of all information uploaded into MyLevelBid, including bid packages, subcontractor proposals, project documents, pricing information, scope information, and related construction data. MyLevelBid does not claim ownership of customer data.
By using the Service, you grant MyLevelBid a limited license to host, store, and process customer data solely as necessary to provide, maintain, secure, and improve the Service — including the automated analysis described above. We do not use your content to train machine-learning models, and neither do our service providers. You are responsible for ensuring you have the rights and permissions to upload any information you submit.
6. Subscription & payment
The Service is currently offered with a free trial, and features available during the trial may change. Certain features may require a paid subscription in the future; if we introduce or change paid plans, we will give you clear notice and the choice before you are charged — there are no surprise conversions of free accounts into paid ones.
Where a paid subscription applies, you agree to provide accurate billing information, maintain an active payment method, and pay all applicable fees. Paid subscriptions may renew automatically unless cancelled according to the applicable cancellation terms, and fees are non-refundable except where required by law or expressly stated by MyLevelBid.
7. Intellectual property
The MyLevelBid platform — including its software, design, user interface, features, technology, documentation, branding, and proprietary systems — is owned by or licensed to MyLevelBid and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable right to access and use the Service during your subscription or trial period. You retain ownership of your uploaded project information, documents, and bid data; nothing in these Terms transfers ownership of customer data to MyLevelBid.
8. Third-party services
MyLevelBid may integrate with or rely on third-party services, including cloud infrastructure, authentication providers, payment processors, analytics providers, and other technology partners. Optional integrations (such as Procore) connect the Service to accounts you hold with third parties; your use of those services is governed by their own terms, and we are not responsible for services outside our reasonable control. You can disconnect an integration at any time in Settings.
9. Service availability
MyLevelBid works to maintain reliable access to the platform but does not guarantee that the Service will be uninterrupted, error-free, or available at all times. Temporary interruptions may occur due to maintenance, updates, security improvements, technical issues, or events outside our control.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND ACCURACY OF ANALYSIS RESULTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLEVELBID WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES — INCLUDING DAMAGES ARISING FROM BIDDING, AWARD, OR CONTRACT DECISIONS MADE USING THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE PAID NOTHING. MyLevelBid provides tools to assist with bid analysis and decision-making; customers remain responsible for their own professional judgment, project decisions, estimates, contracts, and business outcomes.
12. Indemnification
You will defend and indemnify MyLevelBid against claims arising from your content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
13. Termination & suspension
You may stop using the Service and request account deletion at any time, according to your subscription terms. MyLevelBid may suspend or terminate access if these Terms are violated, payment obligations are not met, account activity creates security risks, the platform is used improperly, or as required by law. Upon termination, access may be discontinued, customer data handling continues according to the Privacy Policy, and outstanding payment obligations remain due. Sections that by their nature should survive termination — including “Your decisions are yours,” disclaimers, limitation of liability, and indemnification — survive.
14. Confidentiality
Both parties agree to protect confidential information received through the relationship, including project information, pricing information, business information, technical information, and proprietary processes. Confidential information will only be used for purposes related to providing or using the Service.
15. Governing law
These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
